Village Zoning
One of the primary advantages of being incorporated as a Village is the ability to control community growth and development through zoning regulations. The Building Zone Ordinance is a set of rules established in order to maintain the community standards desired by residents. These rules protect all residents from unwanted change and development. It is important that all residents understand the various guidelines whenever they seek to change or improve their property.
In 1939 a comprehensive Building Zone Ordinance was adopted. This ordinance, which is basically followed today. It has been amended from time to time, but always in keeping with the basic development policy of the Village. This policy, briefly , provides that the predominant use of land throughout the village consist of low-density one-family residential development.
Although a limited area at the extreme north end of the Village has always been zoned for retail business uses, the value of light industry was not perceived until after the huge Sperry plant (now called Lockheed Martin) was built during World War II. In the 1960s careful study of marginal, undeveloped areas near the borders of the village by the Village Planning Board and its professional consultants resulted in the re-zoning of three of these areas for highly restricted non-residential uses. Development of two of these areas in the northeast and southwest corner of the Village, resulted in attractive buildings and site layouts with occupancy as offices, research laboratories and light manufacturing.
The orderly growth of Lake Success has been guided by the Planning Board appointed by the Mayor with the consent of the Board of Trustees. This Board approves site plans, subdivision plans, and oversees the aesthetics of buildings that are erected in the Village, both residential and commercial.
The Board of Appeals, also appointed by the Mayor with the consent of the Board of Trustees, acts in a semi-judicial capacity. It hears appeals of applications that have been denied by the building inspector or the Planning Board because they do not comply with our zoning ordinances.
The function of the building inspector is to issue permits to build, extend, or improve property. He inspects for conformance with the Building Zone Ordinance and Building Code and issues certificates of occupancy. All plumbing and electrical construction work must be done pursuant to a permit either issued by the building inspector or authorized by the Board of Zoning Appeals. performed Monday through Friday from 8:00 am to 6:00 pm.
